This is when many of us make our annual resolutions about what we plan on doing in the upcoming year. I have a suggestion for one you may not have heard before: Make a will. I recently helped a long-term client (a recent widow) sell their home, but her deceased husband had never made a will. This cost her big time as she had to share 50% of the net proceeds (a substantial amount) with his 2 estranged children, and, at a time when she was entering retirement. It was his intention to leave 100% to his widow, but, because he didn’t have a will (“intestate”), his children from a prior marriage were entitled to half the net proceeds. Fortunately, she found them through Facebook and they agreed to sign the legal documents to sell the home. If that hadn’t happened, it would have been a long, drawn out affair which may have cost her all of the equity since she would have gone into foreclosure.
Now, I’m not an attorney and I always recommend you use one to create a will, but, if that is not feasible due to finances you might want to check out this site: https://texaslawhelp.org/. Either way, please, for the sake of your heirs, create a will!
